Oregon Field Sobriety Tests
Challenging a Drunk Driving Field Sobriety Test in Portland
While Breathalyzer and other chemical testing will produce scientific results, the success or failure of a field sobriety test is based on a police officer’s findings. Essentially, your future is in the hands of a law enforcement professional who may have received inadequate training to administer a field sobriety test. Procedures were not followed and steps were skipped, resulting in serious DUI charges.
At Helzer & Cromar, we take a detail-driven, fact-based approach in providing both aggressive representation and rights protection on behalf of our clients.
Do not assume that the results of your field sobriety test are accurate. Take action and contact us at (206) 957-7273 or toll free at 866-930-2812.
The Fallibility of Oregon Field Sobriety Tests
A field sobriety test is subjective, at best. Police officers administer a series of tasks for the “test subject” to perform. Based upon their observations, an arrest can be made for driving under the influence of alcohol or drugs. Law enforcement professionals must receive initial training and continue to adhere to the strict rules in administering the test.
Various factors can result in a field sobriety test getting thrown out of court. Beyond competency issues in the arresting officer’s test administration, weather conditions can create slippery surfaces. Poorly maintained roads can result in cracked and uneven pavement. A disability could cause difficulty in both standing and walking in a straight line.
In building a strong DUI defense, we review the videotape of the field sobriety test. If a police officer fell short in any aspect of testing, we bring that to the attention of the court. Our goal is to minimize the consequences of a DUI charge, or have the case dismissed.
